- Jimenez says he ordered a plate of sizzling fajitas and was told to enjoy his meal but not warned it was hot, even though it was ‘sizzling’.
- After he began to pray, Jimenez heard a sizzling and a pop, then a burning sensation on his face – after which he dropped the meal on his lap.
- The appellate court said the restaurant had no obligation to warn Jimenez, as the danger posed by the sizzling plate was ‘self-evident’.
